These Terms and Conditions govern your access to and use of the website of the Tygerberg Children’s Choir (“TCC”, “the Choir”, “we”, “us”, “our”) as well as participation in the Choir’s activities, including auditions, membership, donations, performances and related programmes.

By accessing the website, submitting forms, making a donation, or participating in Choir activities, you agree to be bound by these Terms and Conditions.

If you do not agree, you should refrain from using the website and engaging with the Choir’s services.

2. DEFINITIONS

“Website” means www.tcc.co.za and any related pages, forms and content.
“User” means any person accessing or using the Website.
“Chorister” means a child accepted as a member of the Choir.
“Donation” means any voluntary financial contribution made to the Choir.
“Content” includes text, images, logos, recordings, downloads and other material made available by the Choir.


3. WEBSITE USE

The Website is provided for general information about the Choir, its activities, auditions, performances and supporter programmes.

You agree not to:

  • Use the Website for unlawful or fraudulent purposes

  • Attempt to gain unauthorised access to systems or data

  • Introduce malicious code

  • Scrape, harvest or copy content without permission

  • Interfere with the proper functioning of the Website

Content is provided for general information only and does not constitute a binding agreement unless confirmed in writing.


4. INTELLECTUAL PROPERTY

All Content on the Website and in Choir materials is owned by or licensed to the Tygerberg Children’s Choir and is protected by South African and international intellectual property laws.

You may not copy, reproduce, distribute, modify or publish any Content without prior written consent.


5. ELECTRONIC COMMUNICATIONS (ECTA)

In terms of the Electronic Communications and Transactions Act 25 of 2002:

  • Data messages and electronic records are admissible to the extent permitted by law.

  • Electronic communications are deemed received when they enter the recipient’s information system.

By submitting forms or communicating electronically with the Choir, you consent to electronic communication.


6. AUDITIONS AND ADMISSION

Submission of an audition application or nomination does not guarantee acceptance.

Admission is at the sole discretion of the Choir’s musical leadership and committee.

The Choir’s decision regarding admission is final.


7. MEMBERSHIP COMMITMENT

Membership is a structured commitment.

Choristers are expected to:

  • Remain members until the end of Grade 9

  • Attend scheduled rehearsals and performances

  • Uphold the Choir’s standards of conduct

  • Represent the Choir responsibly

The Choir reserves the right to review or terminate membership where attendance, conduct or financial obligations do not meet required standards.


8. REHEARSALS, PERFORMANCES AND TOURS

Rehearsal schedules are communicated during school terms and attendance is compulsory unless exceptional circumstances apply.

Participation in performances, competitions and tours forms part of membership obligations.

Tour participation may be subject to additional costs, travel requirements and documentation.

The Choir shall not be held liable for delays, cancellations or disruptions caused by circumstances beyond its reasonable control.


9. FINANCIAL CONTRIBUTIONS

Parents or guardians are responsible for payment of:

  • Monthly contributions

  • Once off joining fees

  • Uniform rental fees

  • Tour related costs where applicable

Failure to meet financial obligations may result in review of membership.

All fees are subject to revision upon reasonable notice.


10. UNIFORMS

Official Choir uniforms must be worn at designated events.

Where uniforms are rented, they remain the property of the Choir and must be returned in good condition upon termination of membership.


11. DONATIONS AND FRIENDS OF THE CHOIR

Donations are voluntary contributions in support of the Choir’s operations.

Donations:

  • Are non refundable unless required by law

  • May be allocated at the Choir’s discretion

  • Qualify donors for recognition levels under the Friends of the Choir programme

Friends of the Choir benefits are subject to availability and scheduling constraints.


12. USER SUBMISSIONS

Any information, files, photographs or other material submitted to the Choir must be lawful and accurate.

You warrant that you have the right to submit such material.

The Choir may use submitted information for administrative, communication and operational purposes.


13. PROTECTION OF PERSONAL INFORMATION (POPIA)

The Choir processes personal information in accordance with the Protection of Personal Information Act 4 of 2013.

Personal information may be collected for:

  • Audition administration

  • Membership management

  • Communication

  • Donation processing

  • Event coordination

14. LIMITATION OF LIABILITY

Participation in Choir activities is voluntary.

To the extent permitted under South African law, the Choir shall not be liable for direct or indirect loss arising from:

  • Use of the Website

  • Participation in rehearsals, performances or tours

  • Reliance on Website information

Nothing in these Terms excludes liability where exclusion would be unlawful.


15. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall fall within the jurisdiction of the South African courts.


16. AMENDMENTS

The Choir reserves the right to amend these Terms and Conditions from time to time.

Updated terms apply from the date of publication.
